A directive is a legislative act which determines the goal that all member states of the European Union must achieve, but each state decides independently on how to achieve that goal. In other words, Member states are obliged to adopt laws and regulations transposing the content of directives into their legislation within the prescribed timeframe, adopting implementing measures and establishing administrative procedures and capacities. Also, candidate countries for membership in the European Union are, in the process of accession, obliged to harmonize their legislation with the acquis communautaire.

The Regulations on Regulated Professions 2005/36EC and 2013/55EU lay down, inter alia, the rules under which Member states which access and pursue regulated professions in their territory are required to have certain professional qualifications, recognize professional qualifications acquired in other Member states, which allow the holder to access the same profession or to pursue the same profession as in the home Member state. The provisions of this Directive apply to the following seven professions: doctors of medicine, dentists, nurses, midwives, pharmacists, veterinarians and architects.

Roadmap for the implementation of the EU Directive on regulated professions 2005/36EC and 2013/55EU

As a result of the Twinning project "Strengthening institutions and capacities for the implementation of the EU Directive on regulated professions", which was realized from May 2014 to August 2015, a Roadmap for the implementation of the EU Directive on regulated professions 2005/36EC and 2013/55EU was created. , and the Council of Ministers of Bosnia and Herzegovina adopted a Decision on the adoption of the Roadmap for the implementation of the EU Directive on Regulated Professions 2005/36EC and 2013/55EU and was published in the "Official Gazette of BiH" No. 10/16.

Based on the Decision on the Adoption of the Roadmap, the Council of Ministers of Bosnia and Herzegovina adopted the Decision on Designing a Coordinating Institution and Contact Point for the Implementation of the Map, which was published in the "Official Gazette of BiH" No. 30/17.

Article 2 of the Decision apointed the Ministry of Civil Affairs of BiH as the Coordinating Institution for the Implementation of the Roadmap, and Article 3 of the Decision apointed the Center for Information and Recognition of Documents in the Field of Higher Education (CIP) as the Contact Point for the Implementation of the Roadmap.

In accordance with Article 2, paragraph (2), point c) and Article 3, paragraph (4) of the Decision determinating the coordinating institution and the contact point for the implementation of the Roadmap for the implementation of the EU Directive on Regulated Professions 2005/36/EZ and 2013/55/EU, institutions in Republika Srpska, Federation of Bosnia and Herzegovina/cantons /counties and Brčko District of BiH have appointed sub-coordinators and sub-contact points which together with the Coordinating Institution and Contact Point will carry out activities related to the implementation of the Roadmap.

Tasks and role of the contact point

Accordingly to the Decision determinating the coordinating institution and contact point for the implementation of the Roadmap for the implementation of the EU Directive on Regulated Professions 2005/36 / EC and 2013/55 / ​​EU, the duties of the CIP, as a contact point, are:


a) providing assistance to the Ministry of Civil Affairs of BiH as a coordinating institution;

b) providing the necessary information to citizens and interested parties on the recognition of professional qualifications, such as information on relevant legislation in Bosnia and Herzegovina;
c) make available on its website a list of all regulated professions in Bosnia and Herzegovina, including contact details of the competent authorities for each regulated profession, and update them regularly.

d) the contact point is obliged to respond to each submitted request for information within 15 days from the day of submitting the request;

e) the contact point for Bosnia and Herzegovina cooperates with the coordinating institution, sub-contact points from the Republika Srpska, the Federation of Bosnia and Herzegovina/Canton and the Brčko District of Bosnia and Herzegovina.

It is important to point out that the role of the contact point is fully implemented only when legislation in Bosnia and Herzegovina is adopted in accordance with the provisions of the Directive and that the role of the contact point only becomes relevant. Due to the lack of harmonization of legislation in Bosnia and Herzegovina and the launch of a new project in this area, the CIP is still unable to perform its function as a contact point at full capacity.
